		<description>One short-term fix would be to repeal or significantly modify Section 514 of ERISA.  That is the all-encompassing preemption provision that effectively prevents states from experimenting with new approaches to providing health care by forbidding state legislation in the arena of employee benefits.  (Empty preemption).  It is not at all clear to me that the Massachusetts plan - at least as it pertains to employer-provided health care -would survive a well-coordinated ERISA challenge.  (That battle may be going on now for all I know).  This is the same provision that has torpedoed the &quot;Walmart&quot; bills.  I think with minor framing the electorate could be persuaded to let the states perform their historic roles as &quot;the laboratories of new ideas.&quot;</description>
